1

For three decades, the 3rd
Circuit was the only circuit
to require all FDCPA disputes
to be in writing. That changed
earlier this year with its recent
en banc decision in Riccio v.
Sentry Credit.

2

The 3rd Circuit provided
guidance for collectors
who have been sending
letters that relied on Graziano
as a compliance standard.

3

It's possible the 3rd
Circuit might at some
point update or discard the
"least sophisticated debtor"
standard, which has created
so much ambiguity in FDCPA
cases.
