What to Watch in 2020
The two top federal advocacy issues for the ARM industry next year will revolve
around the CFPB's final debt collection rule and the FCC's actions surrounding
the TCPA and call blocking.

s we move closer to the end
of 2019, Washington, D.C., is
beginning to turn its attention
to another presidential election year and
numerous congressional races. While the
outcomes of these races will be important
for the future of the accounts receivable
management industry, a lot can happen
between now and then. That's why we
cannot take our foot off the gas pedal
pushing our advocacy agenda heading
into 2020.

THE CFPB'S DEBT
COLLECTION RULEMAKING
One top issue in 2020 will be how
the Consumer Financial Protection
Bureau's debt collection rule makes
it into its final form. This alone
will be a monumental event for the
ARM industry and will require ACA
International to be engaged with the

CFPB and Congress throughout the
year. As the CFPB moves forward,
it will be critical for the industry to
continue to press for changes we would
like to see from the rule's proposed
form, while continuing to support
aspects of the proposal that provide
much sought-after clarity.
ACA has also been closely following
the timeline of the rulemaking, knowing
that any rule finalized after a presidential
election year faces potential threats and
challenges. Congress has recently used
the Congressional Review Act (CRA) to
challenge rules after they are finalized.
Under the CRA, final agency rules must
be reported to Congress. Once received,
Congress will then have 60 legislative
working days to introduce a special joint
resolution of disapproval of the rule, which
needs to be approved by both chambers.
The catch is that Congress is often out of

session, so 60 legislative working days can
stretch over several months and anything
finalized after the summer of 2020 may fall
into that window.
If President Donald Trump is not
reelected and Democrats take both
chambers, it's possible that a new
administration and Congress could
use the CRA to strike down the CFPB's
debt collection rule. However, even
without a CRA challenge-and it could
be likely that there won't be one-a new
administration could also pose other
challenges to the industry's peace of mind
knowing the rule is finalized.
As a result of the CFPB's unique
structure, and as we have seen under
the Trump administration, the CFPB
has reversed course on several prior
rulemakings completed under President
Obama's administration, including the
payday lending rule, mortgage rule and
