We are urging the FCC to include
more specificity about requirements for
unblocking legitimate calls, for more
narrowly tailored analytics that better target
bad actors and uniform disclosures for
consumers before default blocking.

HOUSE LEGISLATION
MOVES FORWARD
The Stopping Bad Robocalls Act passed
the House of Representatives with a
vote of 429-3. This means that in all of
Congress-including the Senate, which
overwhelmingly passed the TRACED
Act-only four members of Congress have
not voted in favor of "robocall" legislation.
This underscores the gravity of what we
are currently up against in D.C. and why it
has been so significant that ACA and our

members have been engaged during the
process of creating both the House and
Senate legislation.
The original draft of the Stopping Bad
Robocalls Act would have undone much of
the work of the ACA lawsuit. The original
bill defined an autodialer as "anything
coming from a list," similar to the 9th
Circuit Marks decision. It also provided no
recognition of legitimate callers and the
need to unblock calls.
However, in the new language it instead
directs the FCC to define an autodialer
within six months, forcing it to act on the
questions from the ACA lawsuit. In the
legislation, it's also recognized that call
blocking technologies should be "provided
with transparency and effective redress
options for both consumers and callers."

The bill, however, is still not perfect
and has things we do not like, including
defining "called party" as "with respect
to a call, the current subscriber or
customary user of the telephone."
The desire to stop robocalls is one
of the only bipartisan issues to emerge
this Congress, and it is expected that
some compilation of the TRACED Act
and Stopping Bad Robocalls Act will
become law. ACA continues to be active
in all discussions in Congress and at the
FCC to ensure that legitimate callers
are considered in the new policies being
created.
