A Bumper Crop of Wins for ACA's
Industry Advancement Program
While combating vexatious litigation, ACA's Industry Advancement Program
also helps members gain clarity in FDCPA letter language cases.

C

ollection letters are the bane of the
accounts receivable management
industry, providing an expansive
target for Fair Debt Collection Practices
Act and related lawsuits due to the myriad
of federal and state disclosure requirements
for such letters.
Consumer lawyers scrutinize collection
letters, injecting tortured interpretations of
plain language to find possible lawsuits (and
potential paydays) against collection agencies
diligently seeking to comply with the law.
And until recently, the Consumer Financial

Protection Bureau has paid little more than
lip service to the industry's repeated requests
to provide rules clarifying such issues like
debt collection communication practices
and consumer disclosures. While it remains
to be seen what the future will hold for the
bureau's debt collection rulemaking and how
the final rules will play out in practice, debt
collectors hoping for more timely relief from
the courts on the latest consumer attorney
claims regarding collection letters recently
got some clarity.
Continuing its ongoing effort to
strategically take on important legal
battles in the courts to protect the longterm viability of the accounts receivable
management industry, ACA International's
Industry Advancement Program defrayed
the cost of litigation, helping its members
reap significant victories in three FDCPA
letter language cases over a period of just
three weeks from federal courts around the
country.

(D.N.J. May 16, 2019)
A federal district court in New Jersey
granted an ACA member collection
agency's motion for summary judgment
after it was sued for allegedly violating
the FDCPA by including language in
its validation letter that mirrored the
statutory text while also including an
invitation for the consumer to call, which
purportedly created confusion over the
writing requirement for disputes. Ruling in
favor of the agency, the district court held
that the agency's invitation to call did not
overshadow or contradict the validation
notice's disclosure that disputes must be
made in writing.
