Defending Against PrecedentSetting Consumer Lawsuits

I

n 2015, my company was sued by a
consumer asserting Fair Debt Collection
Practices Act class-action claims related to
medical debt credit reporting. The consumer
had visited a physical therapist nine times. We
treated each unpaid debt as separate items,
which is how we received them from the
client, but the consumer thought they should
have been treated as one debt.
I initially looked at this case and thought
it would go nowhere. I was wrong. We
tried to settle it to make it go away, but that
didn't work. By that point, I'd already spent
a significant amount of money and I knew
it was going to cost me much more, so I
applied for a monetary award from ACA's

International president, and he
consistently encourages our use of ACA and
its resources. Our company actively shares
ACA's articles and knowledge points, we use
many of ACA's training materials to educate
our employees and we attend association
events to help keep our company compliant
and progressive. That's how I found
out about ACA's Loomer-Mortenson
Scholarship program.
I'm a trainer for Nationwide, but I'm also
taking classes for my undergraduate degree.
There are so many growth opportunities
within my company that I flip-flopped
between majors, but my goal now is to
obtain my bachelor's degree in business
administration. I want to look at my

company from a higher level to decipher
what business choices we should be making
in all areas. I also want to make sure I'm
providing the best care to our employees,
just as our founder does. Basically, my goal is
to be greater today than I was yesterday.
Winning the scholarship helped me
maintain my educational focus. As if the
collection industry has not proven enough
that things change on a consistent basis,
now it's given me the financial resources to
help me adapt and provide guidance to our
employees regarding change management
and problem-solving. Ultimately, it's setting
me up to have a much more impactful role
so that I can teach and lead others. I believe
the knowledge I obtain not only from my
college courses but also from ACA will give
me a pipeline to success and growth.

Industry Advancement Fund to help out.
ACA's Judicial Committee determined we
had a potentially precedent-setting case on
our hands that could affect the entire the
accounts receivable management industry.
Everyone thought we were going to win the
district case, but we lost. In his decision, the
judge got the facts of the case wrong. It was a
very puzzling and frightening time for us. At
first, we weren't sure how we were going to
proceed. We decided to appeal even though
we're in the Seventh Circuit, which doesn't
usually give our industry favorable decisions.
Fortunately, the judge in the district case
retired and we got a new one, who went our
way and ruled that we didn't misrepresent
the "character" of the consumer's debt when
we reported it.
I describe this case as the Foti for health
care debt collections. I think it's a huge,
important decision for anyone in health care
collections because the Seventh Circuit's
decision created a rule of law for both courts
and debt collectors to follow.

If ACA's Industry Advancement Fund
didn't exist, I could not have continued with
the case. We're a small company and it was
just too much liability for us to fight without
help. I am extremely grateful it helped us get
a decision that benefits not only us, but so
many other ACA member companies.
