MARYLAND
The Mid-Atlantic Collectors Association
(MACA) faced several legislative proposals
in Maryland that, if enacted, would have
significantly hindered third-party collection
activity in the state. This included S.B. 22
and H.B. 673, which aimed to significantly
increase the amount of wages exempt
from garnishment. After the legislation
was successfully amended to reduce the
proposed exemption, the legislation stalled
and eventually failed upon adjournment.
The Maryland legislature also considered
several proposals which would have
subjected anyone collecting consumer debts
in the state to licensure and regulation as a
student loan servicer, regardless of whether
the collector operated in the student loan
space. MACA successfully worked to have
that overly expansive provision removed
from the legislation.
Additionally, the MACA lobbying
team worked on legislation (S.B. 42) that
was enacted to clarify that the statute of
limitations for a debt collection action is
tolled if the debtor and creditor enter into a
repayment and agreement.

CA International and its 37
state and regional units have
been busy working on over 670
bills introduced in 46 state legislatures
across the country. Using more than 30
lobbyists, ACA and its units continue to
lead efforts both supporting and opposing
state-level legislation, often organizing
and participating in broad coalitions that
collectively advocate for shared interests.
The 2018 legislative cycle has been one of
the busiest in recent memory, and that high
level of activity is expected to continue right
up until the November election.
Here, we explore some of the state-level
legislative highlights we've seen this year.

INDIANA
The Indiana Collectors Association
(ICA) has worked diligently over the last
year to craft legislation to combat mass
dispute letter mills. Earlier this year,
S.B. 420 was introduced to help alleviate
the letter mill problem and provide
some much-needed transparency to
consumers.
The legislation would require a simple
notification on communications from
credit repair organizations to consumers or
businesses indicating the communication
is from a credit repair organization. As
it stands now, these communications
from credit repair organizations are often
crafted so they appear to be sent directly

from a consumer, when in fact they are
not. Failing to disclose the true identity
of the sender causes confusion with
consumers and businesses alike.
S.B. 420 successfully passed the state
Senate with overwhelming bipartisan
support and passed out of committee in the
House. The legislation did not pass before
the legislature adjourned for the year, but
ICA will continue to work on this issue.

OREGON
The Oregon Collectors Association
(OCA), like many ACA units this
year, saw several legislative proposals
dealing with data breaches. There was a
significant uptick in legislative activity
in this area following several high-profile
data breaches last year. Close to 100 bills
that touched on security breach issues
were introduced in state legislatures over
the last year.
OCA worked on S.B. 1551, a bill that
before being amended would have included
a private right of action against the entity
that was breached, and would undo binding
arbitration clauses.
OCA also worked with the legislature to
pass S.B. 1553, which clarifies the intended
scope of legislation signed into law last
year, H.B. 2356. The legislation stated
that only debt buyers and debt collectors
working on the debt buyer's behalf are
subject to the provision (Oregon Revised
Statute 646.639(2)(t))), requiring a debt
collector to provide certain information
at the consumer's request. The
requirement does not apply to thirdparty debt collectors collecting on
non-purchased debts.
