wireless-only. This means that a majority of
American households now have no landline
in the home and exclusively use wireless
communication devices.
There are also significant generational
differences in those homes that are
wireless-only relative to those that still
have a landline. For example, 72.7 percent
of 25-29 year-olds live in a wireless-only
household. However, only 23.5 percent
of consumers over the age of 65 live in a
wireless-only household.
Because of these dramatic differences in
wireless-only households across age groups,
attempted compliance with the FCC's
broad interpretations of the TCPA will
likely result in certain consumers receiving
a disproportionate number of businessrelated phone calls while other segments
of the consumer population are almost
entirely excluded.
Specifically, if a company only calls
consumers who possess a landline telephone
in an effort to minimize potential TCPA
liability, they are more likely to contact
consumers 65 years of age or older.
In light of these findings, ACA argues
that modernization of the TCPA will ensure
consumers are not deprived of normal,
expected and desired information; will
provide clarity for businesses to engage in
targeted, beneficial communication with
specific consumers; and free the courts
to attend to the needs of real victims of
harassment and abuse.

FCC COMMISSIONER URGES TCPA
REFORM AT ACA'S WASHINGTON
INSIGHTS CONFERENCE
At ACA's three-day Washington Insights
Conference, held on Capitol Hill in May,
FCC Commissioner Michael O'Rielly
addressed a record crowd of attendees

in his keynote address, emphasizing the
need for clear and rational TCPA rules,
as well as guiding principles for future
TCPA regulations.
As a vocal critic of the expansive
interpretations of the TCPA under former
FCC Commissioner Tom Wheeler,
O'Rielly told the crowd of debt collection
professionals that the FCC has expanded the
boundaries of the TCPA "far beyond what I
believe Congress intended, as evidenced by
the actual wording of the statute."
Throughout his presentation, O'Rielly
received generous applause as he addressed
some of the critical regulatory issues that
create costly problems for ACA members.
To stress the out-of-touch interpretations
of the 2015 TCPA Declaratory Ruling and
Order, O'Rielly displayed a vintage rotary
dial phone and said, "here is one of the
only devices the previous commission
wanted your industry to use to make calls
in the 21st century-a rotary phone. Yet
even if callers had the option to manually
dial, it is ridiculous to expect that they
would dial hundreds or thousands of
numbers by hand."
ACA's Washington Insights Conference
featured other informative speeches
delivered by notable figures, including
former House Speaker Newt Gingrich.
Echoing other speakers who took the
podium, Gingrich agreed that having the
ability to "explain your side of an issue" is
the key to passing laws in Washington.
Meanwhile, several members of the
House Financial Services Committee met
with conference attendees after debating
the merits of the Financial CHOICE Act,
which contained language to reform the
CFPB. This year attendees held a record 130
congressional meetings, 28 of which were
with members of Congress.
