presidential power and demonstrate why
the PHH case is vastly different from the
other Supreme Court cases cited by the
judges. In its closing, PHH also urged the
panel of judges to reinstate the statutory
holdings from the October 2016 panel
opinion, noting their importance to industry.
ACA filed an amicus (friend of the court)
brief March 10, 2017, in the PHH Corp.
case to share with the appellate court why it
believes the bureau's powers must be reined
in within constitutional bounds to ensure
accountability and transparency. In its brief,
ACA argued that "[t]he Bureau's structure
and function -wielding power over a broad
swath of Americans' lives, concentrating
power in the hands of a single Director,
insulated from democratic accountability-
is ripe for the arbitrary and unrestrained

exercise of power in disregard for due process,
and for the constitutional rights of the objects
upon whom that power is exercised."
Although a decision by the D.C. Circuit
could come at any time, it is not expected
until the first part of 2018.

ACA CHALLENGES THE FCC
At press time, ACA and the credit and
collection industry continued to await a
decision from the D.C. Circuit Court of
Appeals in the ACA Int'l, et al. v. Federal
Communications Commission case, which
could have a significant impact on the rules
governing calls and texts to consumers.
The ACA Int'l case challenges the validity
of the FCC's oft-criticized interpretations
of the Telephone Consumer Protection
Act. ACA filed the first petition for review

within hours after the FCC issued its TCPA
Order in July 2015.
"ACA sought judicial determination of
whether the FCC ignored the controlling
statute in order to expand the scope and reach
of the TCPA in a way that Congress never
intended, leaving a law in place that hurts
legitimate, law-abiding businesses," Karen
Scheibe Eliason, ACA's corporate counsel, told
attendees at ACA's Convention & Expo in July.
Last fall, the D.C. Circuit Court heard
an oral argument on the case that lasted
nearly three hours. ACA's appeal, as well as
the subsequent appeals filed by nine other
businesses and organizations, were later
centralized in the D.C. Circuit by the Judicial
Panel on Multidistrict Litigation.
